1. Introduction
Welcome to Laghavi Digital.
These Terms & Conditions govern your access to and use of the Laghavi Digital website, marketing dashboard software, related features and associated services.
Laghavi Digital provides marketing intelligence solutions designed to help businesses analyse advertising performance, compare creative approaches, research observable competitor advertising activity and make more informed marketing decisions.
By accessing our website, requesting our services or purchasing a licence, you agree to the applicable terms described below. Additional terms may apply where they are agreed upon in a separate quotation, licence agreement or service agreement.
If you do not agree with these Terms & Conditions, please do not use the relevant services.
2. About Our Services
Laghavi Digital offers a marketing dashboard that may include features such as:
Advertising performance analysis and campaign comparisons.
Creative analysis, including hooks, formats and creators.
Competitor advertising research using available information.
Historical advertising data and creative test analysis.
AI-assisted insights, workflows and recommendations.
Integrations with supported advertising, analytics, search and social media platforms.
Customisation and configuration based on agreed business requirements.
Features and integrations may vary depending on the software version, technical feasibility, platform permissions and the scope agreed upon with each customer.
Not every feature or integration is necessarily available in every installation.
3. Personalised Setup and Customisation
The marketing dashboard is offered through a personalised setup and direct licensing process rather than a standard self-service signup.
Before proceeding, customers may discuss their requirements with Laghavi Digital, including:
Required features and reporting capabilities.
Supported marketing platforms and integrations.
Installation and configuration requirements.
Customisation requests.
Licensing duration, pricing and support arrangements.
Customisation requests are subject to technical feasibility, resource availability and prior discussion and agreement.
Any work outside the agreed scope may require a separate quotation and approval. Laghavi Digital is not obligated to implement additional features unless the work has been agreed upon.
4. Licensing and Permitted Use
Access to the dashboard is provided under the licence terms agreed upon at the time of purchase.
Depending on the agreed arrangement, a licence may be issued for a specified period or under another expressly agreed licensing model.
Unless expressly authorised in writing, customers may not:
Copy, resell, sublicense, distribute or commercially exploit the software beyond the rights granted under their licence.
Share, transfer or redistribute licence keys or access credentials without authorisation.
Attempt to bypass licence validation, access restrictions or technical protections.
Reverse engineer, decompile or disassemble the software, except where applicable law permits such activity.
Remove proprietary notices or misrepresent ownership of the software.
Use the software for unlawful activities or to infringe another party's rights.
A licence does not transfer ownership of the software or its underlying intellectual property to the customer.
Any perpetual or extended-duration licence must be expressly identified in the applicable quotation or licence agreement. The duration of a licence alone does not automatically include perpetual updates, maintenance, hosting or technical support.
5. Pricing and Payments
Pricing is determined according to the selected licence, installation requirements, integrations and any agreed customisation.
Customers will receive the applicable price and payment instructions before proceeding with a purchase.
Payments may be arranged directly with Laghavi Digital through the agreed payment method. A purchase is considered confirmed according to the payment and acceptance conditions stated in the relevant quotation or agreement.
Customers are responsible for paying the agreed amounts by the applicable due dates.
Additional work, third-party services, hosting, API usage charges or other external costs will be communicated where applicable and may require separate payment.
Applicable taxes will be charged where required by law.
6. Licence Activation and Delivery
Where applicable, Laghavi Digital will provide the agreed software access, licence key, installation or configuration after the relevant purchase and activation conditions have been met.
Delivery timelines depend on the agreed scope, payment confirmation, platform authorisations, technical requirements and availability of required third-party services.
Where installation or integration is delayed by circumstances outside Laghavi Digital's reasonable control, the parties may need to agree on a revised timeline.
Customers are responsible for providing accurate information and the necessary account permissions required for the agreed setup.
7. Renewals, Expiry and Suspension
Where a licence has a defined duration, access may expire at the end of that period unless it is renewed or another arrangement is agreed upon.
Renewal prices, renewal periods and any changes to the licence terms will be communicated through the applicable renewal arrangement.
Laghavi Digital may suspend or terminate access where reasonably necessary due to non-payment, suspected unauthorised use, security risks, unlawful activity or a material breach of these Terms & Conditions.
Where appropriate and legally permitted, we will provide notice and an opportunity to resolve the issue before suspension or termination.
Suspension or termination does not remove payment obligations that have already become due.
8. Third-Party Platforms and Integrations
The dashboard may rely on services provided by third parties, including advertising networks, analytics providers, social media platforms, AI providers and other software services.
These third-party services are governed by their own terms, policies and technical requirements.
Customers may need to authorise access to their own accounts and maintain the permissions necessary for an integration to operate.
Laghavi Digital does not control third-party decisions concerning API access, account restrictions, platform policies, data availability, pricing or service discontinuation.
An integration may become limited or unavailable if a third party changes its API, permissions, pricing or terms. We will assess the available options where reasonably practicable, but cannot guarantee that every integration will remain available indefinitely.
Customers are responsible for complying with the terms and policies applicable to their connected accounts.
9. Competitor Advertising Research
Certain features may help customers review publicly observable competitor advertisements, creative variations and other available advertising information.
These features do not necessarily provide access to private competitor account data, actual sales, profitability, campaign budgets or confidential performance metrics.
Information visible through a third-party platform may be incomplete, delayed or subject to change.
Customers must not use competitor research features to obtain unauthorised access to accounts, bypass technical restrictions or engage in unlawful data collection.
10. AI Features and Recommendations
Some features may use artificial intelligence to analyse available data, identify patterns, generate insights or suggest possible marketing actions.
AI-generated information may be incomplete, inaccurate or unsuitable for a particular business situation.
Recommendations concerning campaign scaling, pausing advertisements, creative testing, advertising spend or future performance are intended to support decision-making. They are not guarantees of results.
Customers should independently review important recommendations before acting on them.
Unless expressly agreed and technically supported, AI recommendations do not mean that the dashboard automatically changes advertising campaigns or executes actions on the customer's behalf.
11. Data Accuracy and Tracking Limitations
Marketing data may be affected by factors such as:
Platform reporting delays and attribution differences.
Ad blockers, cookie restrictions and browser settings.
iOS privacy controls and other consent mechanisms.
Missing conversion events or incorrect tracking configurations.
Changes in platform APIs, account permissions or reporting definitions.
The dashboard can only analyse the information available through supported integrations and other agreed data sources.
Laghavi Digital does not guarantee that all advertising interactions, leads, sales, conversions or revenue will be captured or attributed accurately.
Customers remain responsible for verifying their tracking configuration and assessing the reliability of the data used for business decisions.
12. Customer Responsibilities
Customers agree to:
Provide accurate information required for setup and licensing.
Maintain appropriate rights and permissions for their connected accounts and data.
Protect licence keys, credentials and access information.
Use the dashboard in compliance with applicable laws and third-party terms.
Ensure that data they provide or process may lawfully be used for the intended purposes.
Review important AI-generated insights and campaign recommendations before implementation.
Notify Laghavi Digital of suspected unauthorised access or relevant security concerns.
Customers must not use the dashboard to infringe intellectual property rights, violate privacy requirements, conduct unlawful surveillance or engage in fraudulent activity.
13. Privacy and Data Protection
Each party is responsible for meeting its applicable data protection obligations.
Customers should only connect accounts or provide personal data where they have the necessary rights, permissions and lawful basis.
The handling of personal information by Laghavi Digital is described in our Privacy Policy.
Depending on the implementation, the dashboard may interact with data stored by third-party platforms or services. Those providers may process data under their own privacy policies and contractual terms.
Customers should review the applicable Privacy Policy and any relevant data processing arrangements before connecting sensitive business or personal data.
14. Intellectual Property
Unless otherwise agreed in writing, Laghavi Digital retains ownership of its software, underlying code, designs, documentation, proprietary methods and other intellectual property developed or owned by Laghavi Digital.
Customers retain their rights to the data, materials and content they lawfully own or provide.
No ownership rights are transferred merely because a customer purchases a licence or pays for installation and configuration.
Where a project includes custom development, ownership and usage rights for the resulting deliverables will be determined by the applicable written agreement.
Customers must not use Laghavi Digital's name, branding or materials in a way that falsely implies endorsement, partnership or ownership.
15. Maintenance, Updates and Support
Maintenance, updates, technical support and ongoing development are provided only to the extent included in the applicable licence or service agreement.
Unless expressly agreed, a software licence does not automatically include unlimited support, continuous feature development, hosting, third-party subscription costs or future integrations.
Laghavi Digital may release updates, modify features or improve the software over time. We will endeavour to communicate material changes where appropriate.
The availability and timing of updates may depend on technical requirements, third-party changes and the scope of the customer's licence.
16. Availability and Security
Laghavi Digital will take reasonable measures appropriate to the agreed service to maintain the software and protect access.
However, uninterrupted availability cannot be guaranteed. Access may be affected by maintenance, hosting issues, connectivity problems, security incidents, third-party outages or circumstances beyond our reasonable control.
Customers are responsible for protecting their own devices, credentials and connected accounts.
Any hosting, backup, data retention or disaster recovery commitments will be governed by the relevant service agreement where applicable.
17. Refunds and Cancellations
Refund eligibility depends on the nature of the purchase, the applicable agreement, the work already performed and any rights provided by applicable law.
Before making payment, customers should review the agreed licence duration, installation scope, delivery arrangements, support terms and any specific cancellation or refund conditions stated in their quotation or agreement.
Where a purchase includes installation, configuration or custom development, cancellation may affect work already completed or costs already incurred. Any applicable deductions or refund arrangements must be consistent with the agreed terms and applicable law.
Nothing in these Terms & Conditions excludes or restricts a customer's rights that cannot lawfully be excluded or restricted.
18. Limitation of Liability
To the extent permitted by applicable law, Laghavi Digital will not be responsible for indirect or consequential losses arising from the use of the dashboard, including anticipated profits, missed opportunities or business interruption, where such exclusions are legally permitted.
Laghavi Digital does not guarantee advertising performance, conversion rates, revenue growth, campaign profitability or specific business outcomes.
The dashboard is an analytical tool, and customers remain responsible for their advertising strategies, campaign settings, spending decisions and business operations.
Nothing in these Terms & Conditions excludes liability where such exclusion is prohibited by applicable law, including any non-excludable consumer rights or liability.
Any additional liability limitations agreed between the parties must be set out in the applicable written agreement and comply with applicable law.
19. Indemnity
To the extent permitted by applicable law, customers are responsible for losses, claims or expenses arising from their unlawful use of the dashboard, infringement of third-party rights or material breach of these Terms & Conditions.
This provision does not apply to the extent a loss results from conduct for which Laghavi Digital is legally responsible or where the allocation of liability would be unlawful.
20. Changes to These Terms
Laghavi Digital may update these Terms & Conditions to reflect changes to the software, services, business operations or applicable legal requirements.
The updated version will be published on this page with a revised “Last Updated” date.
Changes will apply prospectively where appropriate. Material changes affecting an existing licence or agreement will be handled in accordance with that agreement and applicable law.
21. Governing Law and Disputes
These Terms & Conditions are intended to be governed by the applicable laws of the United Arab Emirates, subject to any mandatory legal requirements and the applicable jurisdiction of the relevant courts.
The parties should first attempt to resolve disputes through good-faith discussions.
If a dispute cannot be resolved amicably, it may be referred to the competent courts or other dispute resolution forum with jurisdiction under applicable law.
The precise governing law and jurisdiction should be confirmed against the company's licensing authority, establishment documents and applicable contractual requirements.
